These Terms of Service ("Terms") govern your use of the website located at vuepointvisuals.com and any photography, video, drone, or media services provided by Vuepoint Visuals ("we," "us," or "our"), operated by its owner doing business as Vuepoint Visuals.
By booking our services or using our website, you agree to these Terms. Please read them carefully.
Vuepoint Visuals provides professional real estate photography, videography, drone/aerial, 3D virtual tours, floor plans, and marketing media services ("Services") for residential and commercial properties.
All shoots are completed by contractors or staff engaged by Vuepoint Visuals. We reserve the right to assign shoots to the most appropriate photographer in your area.
A booking is confirmed when you receive a written confirmation from Vuepoint Visuals via email or our booking platform. Bookings are subject to availability.
You are responsible for ensuring accurate property details — including address, square footage, access instructions, and any special requirements — are provided at the time of booking. Inaccurate information may affect pricing or service delivery.
Pricing is displayed on our website and is based on property size under 2,000 sq ft. Size surcharges apply as listed. Prices are subject to change without notice; the price confirmed at the time of booking is honored.
Payment is due as stated at the time of booking. For Pay at Closing arrangements, separate written terms apply and must be agreed upon before the shoot takes place.
Travel fees may apply for properties outside our primary service area. We will communicate any applicable travel fees before your booking is confirmed.
We understand that plans change. Our policy is simple:
You are responsible for ensuring our photographer has access to the property at the scheduled time. We recommend providing a lockbox code or arranging key pickup in advance.
We provide a preparation checklist at the time of booking. While we will do our best with any condition, properties that are not reasonably prepared may result in images that do not reflect the property at its best. We are not responsible for the outcome of shoots where property preparation was incomplete.
All standard deliverables are provided the next business day via a private download link, unless rush delivery is requested and confirmed at the time of booking. Delivery times may vary during peak periods or due to factors outside our control.
Deliverables include the items specified in your selected package. Additional items not included in your package are not guaranteed unless added and confirmed in writing before the shoot.
Upon receipt of full payment, Vuepoint Visuals grants you a non-exclusive, royalty-free license to use the delivered photos and videos for the purpose of marketing the subject property. This includes MLS listings, social media, print marketing, and listing portals.
You may not resell, sublicense, or transfer rights to the media to third parties without written permission. Vuepoint Visuals retains the right to use delivered media in our portfolio, marketing materials, and social media unless you request otherwise in writing at the time of booking.
Drone services are subject to FAA regulations, local airspace restrictions, and weather conditions. We may need to reschedule or cancel drone portions of a shoot if conditions do not permit safe and legal operation. No charge will apply in these cases.
You represent that the property owner has granted permission for drone operations over the property. We are not responsible for obtaining permission from neighboring property owners or third parties.
To the fullest extent permitted by law, Vuepoint Visuals shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to lost profits, listing delays, or data loss.
Our total liability for any claim arising from our services shall not exceed the amount paid for the specific shoot giving rise to the claim.
You agree to indemnify and hold harmless Vuepoint Visuals and its contractors from any claims, damages, or expenses arising from your breach of these Terms, your misuse of delivered media, or your failure to obtain necessary property access permissions.
Our referral program (when active) is subject to additional terms communicated at the time of enrollment. Vuepoint Visuals reserves the right to modify or terminate the referral program at any time. Rewards are issued only for completed bookings and are not transferable or redeemable for cash except as explicitly stated in the program terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our services after any update constitutes acceptance of the revised Terms.
